Abstract

Robert Tucker, the son of the late Wood Tucker Sr., seeks his share of the slaves in his late father's estate. He reports that Wood Sr. died in 1783, possessed of four slaves, and that his father devised "to Milley Tucker the Mother of your Orator, for her Life the said four Negroes and directed by the said Will that after the Death of the said Milley the said four Negroes with their future Increase should pass to and become the property of your Orator and David Tucker the Brother of your Orator." He charges that David, the executor of said will, "before the Death of your Orators said Mother, ... transferred all his right in the said Slaves and their Increase to Wood Tucker the Brother of your Orator" and "about the same Time delivered to the said Wood Tucker ... the possession of the whole of the said Slaves." Revealing that both Milley and David have died, he argues that his brother Wood has "ever since the Death of the said Milley Tucker has either had possession of the said Slaves or in some other way appropriated them and the profits arising from them to his own use." He further contends that his brother refuses "to make an Amicable Division of the said Slaves." He therefore prays that the court direct "the said Slaves to be actually divided between your Orator and the said Wood, if the same can be equally done;" if said division is not deemed practicable, he requests that said slaves be sold and the proceeds thereof equally divided between "your orator and the said Wood."
