Abstract

The petitioners, in charge of the execution of the last will and testament of the late Andrew Holmes, ask for a "full account" of the proceeds arising from the sale of slaves procured from Africa at the behest of Andrew Holmes & Co., the testator's trading firm. The firm contracted with Charles Christie to buy slaves and bring them back to Charleston. Christie captained the ship's return to Savannah instead, where the slaves were sold to the firm of Caig & Mitchell. The "monies, produce, bonds and Notes" used to purchase the slaves, which amount to $92,845, passed into the possession of John Bolton, who was supposed to deliver them to the petitioners, who were "entitled to receive and administer them according to law." The money is sorely needed to discharge estate debts, and the petitioners ask the court to intervene in the dispute, naming the estate's creditors as party defendants. Included as a related document is a thirteen-page report from a four-man arbitration committee.

Result: Partially granted; settled through arbitration.
