Abstract

George and Daniel Wade ask the court to enforce a verbal agreement they made with Reuben Harrison to discharge their obligation on a bond they secured for Nathaniel Casey. In 1802 Casey contracted with Harrison to deliver twelve slaves to him at the price of $300 per slave. By the following year when Casey had not honored the contract, the Orangeburg sheriff, William Rowe, attached the slaves in question, who were legally the property of Joshua Prout. In order to aid Casey in reclaiming the slaves from the common jail, the petitioners agreed to become securities for Casey's bond. Immediately thereafter, Harrison commenced action against the petitioners for the sum of $4500, causing Rowe to levy George Wade's property to satisfy the debt. The Wades consider the proceedings "vigorous & unjust ... with reference to Casey alone [but] much worse so when made a means of recovering an excessive penalty against them." When they offered to deliver five slaves to Harrison to offset the debt, he "positively agreed" to the arrangement but then later refused to receive them. They seek the court's assistance.
