Abstract

Charles Lynch claims that Elisha Lindsey was indebted to him "in the sum of one thousand Dollars & upward" on 8 January 1808. Lindsey proposed that Lynch "become his Security in the Purchase of Twenty five African Negroes." Lynch agreed, provided that all the slaves "be placed in his possession, as a counter security for himself" and that "one half of the said Negroes should be considered as the property of your Orator, & he to be at liberty to dispose of the said Negroes to the best advantage." Lindsey proceeded to purchase 25 slaves from Joseph Walden at the rate of $290 per slave. After providing a small cash advance, Lindsey secured the purchase with a note for $5800 endorsed by Lynch. The petitioner states that he and Lindsey were to depart for Columbia together and that "the said Africans ... were to be placed in the charge of a Negroe Slave belonging to your Orator who was directed to conduct them to Columbia there to be delivered to & disposed of by your Orator." He reports that Lindsey "made some excuse for remaining behind" and that Lindsey, "immediately after leaving him, took possession not only of the said Africans, but of your Orator's Negroe slave aforesaid" and is now proceeding "to leave the State of South Carolina," leaving him "to pay off the note aforesaid." Deprived of "his right to one half of the said African Negroes," Lynch prays that Lindsey "be compelled to deliver the said African Negroes to your Orator, & be decreed to come to a fair & just Account with your Orator."
