Abstract

John Frost asks the court to compel Samuel Wells "to come to a fair & Honorable settlement" with him regarding two business transactions. In 1807, Frost and Wells joined in a "verbal agreement" whereby Wells consented to take a slave, jointly purchased by the pair, to Tennessee in order to make a profit. In Tennessee Alexander Outlaw purchased the slave for $350 "payable in Pork." Wells later received $700 from Outlaw as "the price of Pork was at that time high." Wells neither accounted with Frost, nor did he make good on the promissory note that he and Frost co-signed for the slave. Frost and Wells also "entered into copartnership" to purchase goods from William Sherlock and Augustus Durke using Frost's slave Prince as partial payment. Wells agreed to settle for the goods, but paid Durke only. Sherlock has begun a suit to try to collect his debt. Frost asks the court to protect his investment by ordering Wells to compensate him for the proceeds of the first sale and for his capital in the second.
