Abstract

William Wade seeks a division of slaves and an injunction to prevent the sale of one slave. He asserts that his mother, Elizabeth Wade, "was entitled ... to a considerable personal property" by her father's will, "Subject however to the payment of ... her proportion of the Debts due by her said Father." Elizabeth Wade died sometime after 1791, before the executors delivered the slaves, so her husband Thomas took charge of them. William claims that his father agreed to hold some or all of the slaves in trust for his two sons and later to divide them with the boys. Now of age and administrator of his mother's estate, William asked his father to divide the slaves and to account for their labor while in his possession, but his father refused. Moreover, Abraham Perry, the sheriff of Lancaster district, levied on a slave named Peter to pay "an execution ... against yr orators said Father." Perry intends to sell the slave "at the next Sale day." William Wade asks for an injunction to stop Peter's sale. He also asks the court to compel Thomas Wade to account for the slaves' labor over the years and to divide the slaves with his sons "as in Justice and Equity he ought to do."
