Abstract

John Frost died intestate in 1798, leaving a wife, Judith, and their two children, Mary and John. Shortly after his death, his wife took out letters of administration on his estate, which includes fifteen slaves. Judith has since married Judah Barrett, and she and her husband are holding the slaves and property of John Frost's estate, claiming that they cannot "lawfully" divide the estate "but by and under the sanction of this Honorable Court." Mary and her husband, John Kinsler, ask the court to subpoena the Barretts and to issue a writ of partition requiring them to divide the slaves among the heirs.

Result: Granted.
