Abstract

William Rose sold a group of slaves to Josiah Rhodes for $750. As a condition of the sale, Rhodes agreed to mortgage the slaves back to Rose until final payment was made. Rhodes died intestate after having signed a promissory note but before legally arranging the mortgage. Peter Crovat and L. P. Descondres have been appointed administrators of Rhodes' estate. They claim the slaves as "the absolute property of the Estate" and allege "the Sale made between their said intestate and your orator, was not on the terms and conditions as mentioned ... aforesaid." Rose asks the court to compel Descondres and Crovat "to consider said Negroes as specifically bound to secure your orator's debt" or to return them to him and to void the bill of sale. Rose also requests that the administrators be required to account for the hire of the slaves.
