Abstract

In 1806 or 1807 Thomas Payne agreed with Henry Walker, the sheriff of Greenville District, to act as deputy sheriff and jailer. Payne states that he was "to have and receive all fees for keeping negroes or other property taken into execution or sent to Jail and all fees that should arise from the confinement of Debtors or other persons in Jail." Payne's duties required him to handle money and exchange receipts, so Walker suggested that Payne record the transactions in a book, and they would settle the accounts later. "Not in the least suspecting such a proposition was made by him with intent to injure or defraud Your Orator," Payne agreed. Henry Walker resigned as sheriff in 1810 after being elected to the legislature. Walker refuses to pay Payne for his work as deputy sheriff and will not recognize the account book as evidence of the debts. Payne also gave Walker "considerable sums of money ... either by lending, payment to himself or some other person for him, by the hire of a Mare and finally by the sale of said Mare and a Gun." Payne offers a partial list of his claims against Walker, but he avers that Walker has a record book, which Walker keeps from him, that would account for other sums of money owed him. Thomas Payne asks the court to subpoena Walker and the missing record book and to order Walker to pay "all the money due him."
