Abstract

Hugh McMullan, the administrator of William Middleton McDonald, asserts that his intestate's grandfather and uncle "neglected and refused to account to the said William M McDonald in his life time, and to Your Orator since the death of the said William M. for the service of the said negroes and the profits of the said lands." The petitioner represents that the father of his intestate, also named William M. McDonald, bequeathed four slaves and four tracts of land to his son. Following the deaths of the intestate's father and grandfather, the said property came into the possession of Middleton McDonald Jr., the executor of Middleton McDonald Sr. and the intestate's uncle. McMullan informs the court that the said Middleton Jr. "has removed his family and effects away, without the limits of this State," thereby limiting "the power of Your Orator to compel him by any process of Law to return the Said negroes specifically to Your Orator." The petitioner, in right of his wife Charlotte, the widow of "said William McDonald," therefore prays that the said Middleton Jr. be compelled to render "an account of the said surplus estate, and payment of what they are entitled to in that behalf" and that he "may be enjoined against removing the said negroes without the limits of this Court."
