Abstract

Thomas and Elizabeth Davis Word ask that James Hunter "account with them for all the personal estate and effects" that he received in his capacity as guardian for the said Elizabeth. The petitioners represent that Nathaniel Davis bequeathed his daughter Elizabeth a female slave named Celia in his 1797 will, stipulating that "if any of the negroes which he had Willed to his children should die the loss should be made good out of his Estate." Noting that the slave Celia died, they report that Davis's executors delivered two slaves to the said Hunter, "as guardian afforesaid," as part of Elizabeth's distributive share of her late father's estate. The petitioners confirm that they have been married about a month and "that since that time they have frequently applied unto and requested the said James Hunter" to account for the property so received as guardian and to "deliver to them the said negroes and pay to them the value of their hire and of the rents and profits of the real Estate." Citing that Hunter "absolutely refuses to comply with such reasonable requests," the Words pray that he "may be decreed to set forth a true and particular account of all the personal Estate and effects and of all sums of money and of all Legacies which have come to his hands or become due to him as guardian ... and that the same may be paid and delivered over to orator and oratrix."
