Abstract

David DeWalt seeks an account of the estate of his late father, Daniel DeWalt. He states that his father died in 1806, having previously executed a will that devised his "considerable Estate real and personal" to his widow Nancy and to his children. The petitioner charges that his mother Nancy, the executrix of said will, has unduly benefited from the property in said estate. He cites that she and Edward Thweatt, executor of said will, "fraudulently sold before the hours of [the estate] sale and before the bidders were collected three African negroes," worth $1100, to the said Nancy for $755. He further complains that his mother "is now living upon enjoying and occupying the plantation left by the will of Daniel DeWalt deceased to David DeWalt your orator;" that she is charging him "for his board cloathing and Schooling," when, in fact, "his maintenance and education" should be derived "from the profits of the said negroes;" and that she has failed to account for and distribute "the personal Estate of the said Daniel DeWalt deceased undisposed of by Will." He therefore prays that the executors be summoned to answer his charges and that they be compelled to give a "particular account of all and singular the personal Estate and effects which were of the said Testator." He also requests that he "may receive his Equitable and distributive share thereof with legal Interest."
