Petition #21381422

Abstract

Hugh O'Neall, a confirmed "lunatic," asks that the judgments recovered by the defendants be set aside. O'Neall represents that the defendants obtained their said judgments while he was "non compos mentis" and "before any person was [legally authorised] to act for him." Charging that he has "suffered inconceivable damages on account of the actions" of the defendants, O'Neall further contests the judgments "because a free negroe has been joined as a defendant with your orator in the whole proceedings wherefore he prays that this court would order the proceedings to be set aside." The petitioner therefore requests that the defendants "may be decreed that their judgements be set aside that they pay him the full value of his property sold at sheriffs sale that they repay him the money which they have received on the judgements and that they pay him the full amount of all his claims against them, after allowing such of thier demands as to this honorable court shall appear equitable and just."
