Abstract

John Daggett seeks a writ of injunction to restrain the sheriff of Richland district from selling a slave named Jordan as confiscated property. John Russell, "indebted to Your Orator in several thousands of Dollars," sold Jordan to Daggett in 1820 for $800 to cover a portion of his said debt. Jordan was subsequently levied upon and taken by the sheriff in a case pending against Russell's estate. The sheriff now "intends to make public sale" of the slave to satisfy the executions against Russell's estate. In addition to his prayer for an injunction, Daggett asks the court to subpoena those creditors, who have judgments against Russell's estate. Henry W. DeSaussure's order granting the injunction cites the attachment "between master & servant" as an example of "strong reasons for protecting the owners of Slaves, from the operation of Executions, which have no lien on them, or whilst the right of property is in dispute."
