Abstract

Mary Wiss, the widow of the late John P. Wiss, seeks a distribution of the property in his estate. She informs the court that her husband died intestate in 1816, possessed of a house and lot in Charleston and two slaves named Christmass and Ellen. The petitioner represents that she "is entitled to one third part of all the estate real and personal of her deceased husband" and that her three children "are entitled to the other two thirds." Wiss surmises that "it is desirable to make a distribution of the said estate," but she submits that said estate "from its situation is not divisible without a sale." The petitioner therefore prays that said cause may "be refered to the commissioner of this Honorable Court to report whether such sale be or not [be] desireable."
