Petition #21382124

Abstract

The children of Nancy Powell allege that David Anderson, executor of Absolom Bobo's will, illegally sold five slaves that Thomas King gave to his daughter Amy, wife of Absolom Bobo. King executed a deed of gift in 1783, "by which he lent to his daughter Amy" five slaves for the duration of her life, after which time, the slaves would descend to her daughter, Nancy Powell. Absolom's 1808 will gave Amy the power to dispose of this property "at her will & pleasure." The petitioners assert that Anderson is taking advantage of the blind and nearly 100-year-old Amy, who "from her unfortunate habits of intoxication," cannot manage the estate, which now includes upwards of thirty slaves. Anderson has "prevailed on her recently to confess a judgment" for nearly $3000, and the petitioners fear that the slaves will be seized as payment. They ask the court to compel Anderson "to give security for the forthcoming of the said negroes, at the death of the said Amy." They also seek a partition of the slaves among them.

Result: Partially granted.
