Abstract

Philip Pearson Sr. seeks an injunction to prevent the sheriff from levying on and selling slave property to satisfy an execution won by his son's creditors. His son, William F. Pearson, acting as his agent, used part of a note totaling $6500 to purchase four slaves "for the benefit of the family." The slaves were "sent to your Orators plantation on Broad River," where they have been employed "as field hands in your Orators Service." Recently, however, Pearson Sr. learned that his son transacted the bills of sale for the slaves in his own name and the sheriff levied upon said slaves. The petitioner complains that his son is actually "your Orators debtor," having raised "ten or twelve" crops on his plantation using the slaves in controversy. He asks the court to protect his property rights by decreeing that "the negroes aforesaid are the right and property of your Orator."
