Petition #21382134

Abstract

The heirs of Richard Farr charge that Farr's other relatives have taken Farr's property and inheritance. When Col. William Farr died circa 1794, Richard Farr became one of his father's executors. Because Col. Farr died indebted, the executors and executrix decided to sell the estate to Richard to protect it from creditors. They planned to divide the property between the heirs and to reimburse Richard for his purchase and for other claims that he had against his father's estate. After Richard's death, however, his brother, William B. Farr, became the primary executor of the late Col.'s estate and took control of Richard's property too. William and the other heirs of Col. William Farr claim that Richard owed money to the estate, sold three slaves and "converted the proceeds thereof to his own use," and deeded his plantation to his father. Richard's heirs claim that the estate owed Richard. They allege that William Farr "while the said Richard Farr lay a corpse in his house rudely and unfeelingly seized upon and carried off all the papers money and books of account." William B. "and his confederates" also claim full title to the inheritance of a deceased sister. Richard's heirs ask that William Farr's executors and heirs pay the debts owed to Richard Farr, return the money and property they have seized, give Richard's heirs his fair distributive share of his father's and sister's estates, and account for the rents and proceeds of those shares during the time they controlled the property.

Result: Partially granted pro confesso.
