Abstract

Polly Lining, "Trustee for Mary Blake Sanders & Children," seeks to enjoin the sale of a slave named Tom. Lining represents that James Sanders did "Sell & Deliver" the said slave to her for $800 in 1819 "in Trust for the Use, Benefit & Behoof of his Wife ... without being in any Manner subjected to his Debts." She further charges that John May, the sheriff of Colleton District, has levied on Tom "as the Property of Mr. Sanders" and "threatens to sell the said Negro" to discharge the delinquent taxes owed by the said Sanders. Lining submits that she sent the sheriff two "original Deeds," which documented that Sanders, being "freed of Debts of Every description," did convey "all his right & Interest" in Tom, as well as twelve other slaves, to her and that said slaves were "not Subjected to the Payment of his Future Debt." Noting May's refusal "to set Tom at Liberty," the petitioner prays that the sheriff "may be compelled by an order of this Court to Deliver Him into the Hands of your Oratrix."
