Abstract

John Parham, the executor of the late Reuben Saunders, joins Saunders's widow and children in asking that a "writ of partition" may issue "for the purpose of making partition and division of the Said Estate." Parham recounts that the testator died in 1814 "seized and possessed of a considerable real and personal Estate," which included twenty-three slaves. He further reports that Saunders's will directed that fourteen of said slaves "be equally divided betwen my three children, as they arrive to the age of twenty one or marry." Parham informs the court that petitioner Robert Saunders, "one of the legatees under the Said Will," has married and "is now desirous to have his distributive Share of Said Testators Estate delivered over to him." The petitioners therefore pray that "a writ of partition may be ordered to issue from this hon court for the purpose of effecting the Said division."
