Abstract

Landon Miles, trustee for Bethel New Cross Church, and Joseph Barnett and Miles Rainwater, trustees for Upper Cedar Shoat Church, seek to protect their remainder interest in a slave named Milly and Milly's three children. The petitioners recount that Rev. Spencer Bobo bequeathed the said slaves in 1816 to his wife Jane "during her natural life, & then to descend" to the aforesaid churches. The trustees further report that the said widow "sold & disposed of her life estate in the said negro wench & her children ... to William Hendrix" in 1822. They inform the court that the said Jane has "anxiously" sought the delivery of the said slaves, having offered the said Hendrix "$200, for a recantation, & the said Negroes to be redelivered to her." The petitioners disclose, however, that Hendrix not only refuses to rescind his contract with the widow or to "give to your Orators any assurance whatsoever that the said Negroes shall be forthcoming for the benefit of said Churches after the termination of the said life Estate, but has repeatedly threatened, that he will run said slaves from and beyond the limits of this State, and dispose of them in some foreign & remote parts beyond all reach of the said Churches." They therefore pray that Hendrix be required "to give good and sufficient security that he will not depart without the limits of this State, or take, or cause to be taken & carried away the said Negro slaves herein before set forth."
