Petition #21382310

Abstract

W. S. Boag, guardian of eighteen-year-old John S. Lawson, seeks an injunction forbidding R. A. Taylor from "disposing of" three slaves he purchased in a "fraudulent" sale held by Lawson's former guardian, Mrs. Lester. Boag explains that John's father, Captain Lawson, died prior to 1816 leaving the boy an orphan. Miss Danford, now Mrs. Lester, became his guardian and years later applied to the court, without John's knowledge, to sell three of his slaves. Boag alleges that at the sale--promoted by an advertisement whose terms "were calculated to prevent a profitable sale"--Lester colluded with R. A. Taylor to purchase the slaves for a price "far below the value." Boag reports that he has successfully applied to have Lester's guardianship revoked, and now he asks the court to set aside the transaction's bill of sale, and to order Taylor to return the slaves to his custody.

Result: Partially granted.
