Abstract

The executors of the late William F. Goodwyn seek to pay the estate's large debts. John Howell and Abraham Jones explain that the estate owes $50,000 to various creditors, who are "pressing for payment." Some of the creditors have already won judgments and are "threatening to levy upon the property of the Estate wherever it may be found whether specifically beqeathed or not." Goodwyn willed one plantation with its associated personal property, including slaves, for his wife Martha to use during her lifetime. He willed another plantation and its personal property to his daughter Polly Tucker Goodwyn; her education was also charged to the estate. The estate includes other property not specifically bequeathed, but the executors are having trouble selling it; even if sold, said property would not produce enough money to pay all the debts. To complicate matters, Martha Goodwyn has not decided whether to accept the bequest or to take her common law dower, and both women insist that the other's inheritance should be sold first. The executors ask the court to decide what property to sell and to compel the widow to choose a dower or the bequest. Goodwyn's will, which is found in the decree, shows that Goodwyn left his widow "twelve prime hands."
