Abstract

Hugh Fledger and Thomas Godbold seek an injunction to restrain Patience Whittington from enforcing a judgment for $150 that she won against them. The petitioners first obtained two judgments against Patience's nephew, Francis, who subsequently "absconded" from the state, leaving behind some cotton and a slave named Lucy. The sheriff levied on Lucy, and the petitioners then purchased her at the sheriff's sale. Whittington retaliated by filing suit against them, on the grounds that Francis owed her money before he left the state. The petitioners charge that George Hodge paid Whittington all but twelve or fourteen dollars due her and that she has been doubly compensated for Francis's original debt. They also ask the court to compel the defendants to account with them for the property they have received of Francis Whittington.

Result: Partially granted; overruled; denied.
