Abstract

William Foote seeks the "immediate restoration" to his possession of seven slaves, who are currently detained by James B. Glenn, executor of the will of Newton Foote. The petitioner claims that he bought Cate and her two daughters, Sealy and Ursula, formerly the property of Newton Foote, at a sheriff's sale in 1812. Two years after Newton Foote died in 1823, Glenn instituted suit against William, claiming that William bought the slaves for Newton. Since the purchase of the slaves, Sealy has had one child, and Ursula has had three children. Glenn has seized all seven of the slaves as the property of Newton Foote's estate, and William Foote asks that the slaves be returned to him, beseeching the court that Glenn "shall not be allowed to be the judge in his own cause." He also asks to be compensated for the slaves' hire while Glenn has detained them.
