Abstract

Benjamin Lindsey, executor of the will of his father-in-law, Etheldred King, asks the court either to "legalize the sale and purchase" of a tract of land in the estate, or to set aside the sale and order a new one. King's will directed that the whole of his estate, which included five slaves and several tracts of land, be sold and the profits divided between Lindsey's wife and her three siblings. At the estate sale, Lindsey purchased a tract of land, but later discovered that the sale "may at any time be set aside." He seeks a good title to the land and names King's other heirs as party defendants to his bill. The will also directed that all of the slaves be sold in a lot "as I don't wish to part them."
