Abstract

Eli and Silas Holloman ask the court to remove Joseph Fort from the trusteeship that he shares with Silas with respect to Eli's property. In December 1828, Eli Holloman conveyed his property to Silas Holloman and Joseph Fort. The two trustees were to maintain the property, pay the debts, and otherwise "manage & dispose of the same for the benefit & interest of your orator," Eli. Fort, however, has not "acted in concert with your Orator Silas Holloman" and instead has managed the trust "according to his own interest, whims & caprices." He took a slave from the farm "during a busy season of the year," causing Silas to supply one of his own slaves in order to "preserve" the crops from injury. He then hired out Eli's slaves "contrary to the wishes of your Orators," at a rate "far less" than the amount generated by five slaves the year before. The plantation has fallen into disrepair and is now "actually depreciating." The Hollomans ask that Fort be ordered to reconvey the property to Eli Holloman and that he be enjoined from "further meddling with the property in said deed."
