Abstract

Joseph Robinson asks the court to compel James Maxwell, the administrator of the estate of his late mother, Ann Robinson Daniel, to account with him for property originally derived from his late father's estate. John Robinson's 1779 will gave his children a remainder interest in two slaves, who were devised to their mother, Ann, for her use during her lifetime. After Ann remarried, however, she directly violated Robinson's will by selling one of the slaves, Easter, to an undisclosed buyer, who then took the slave "to one of the South Western States or Territories." Robinson speculates that Easter is now in Mississippi where she has had numerous children. As soon as his mother died, Robinson applied to Maxwell to account with him for his father's unadministered property in his mother's estate, but Maxwell refused to deliver the same. Robinson specifically seeks Easter's return, along with the return of any children she may have had, or compensation for their "true value" and hire.
