Abstract

The "only legal heirs & Distributees of Richard Fryer deceased" ask that the court compel the children of Fryer's second marriage to surrender the property that they have received from Fryer's estate. The petitioners claim that Fryer's "last wife," Rachel, was the "reputed and Lawful wife of a man by the name of Black" when she married Fryer and that the defendants are therefore "according to the Laws of the Land bastards or illegitimate." They inform the court that the defendants, as the will's "principal legatees," received "a Large amount more than one fourth of the Estate contrary to the act of the Legislature in such case made & provided." The petitioners ask the court to compel Rachel's children to account for and "deliver up" the property "by them unlawfully withheld from the complainants." They particularly request that "Randall Crow may be required to deliver up the negro in his possession to the complainants or account to them for three fourths of its value."
