Abstract

Thomas Westcott petitions the court to protect his interest in five slaves. In September 1807, Mary Westcott Boucher put all of her property, including a slave named Maria, in trust. Maria and her increase would become the property of Mary's daughter Julia upon Mary's death; should Julia die without children, the slaves would pass to Mary's son, Thomas Westcott. Thomas informs the court that Mary "exchanged" Maria in 1812 for another slave named Caroline, who has since had four children. Mary Boucher also wrote another deed giving the slaves to Julia when she turned twenty-one years old, but Thomas maintains that it "cannot and does not defeat or destroy your Orator's interest or remainder" in the slaves. In 1830, Julia married Jonathan Crankfield, and they took two of Caroline's children. Julia died without any children, but Crankfield refuses to return the slaves, threatening instead to take Isaac and Adeline out of the state. Thomas Westcott asks that Crankfield be enjoined from doing so and that he provide security to ensure that he will turn over the slaves to Westcott upon Mary Boucher's death.
