Abstract

Mary E. Scott Davis and James B. Davis seek Mary's share of an inheritance. In a related petition filed in 1824, John Scott asked the court to distribute the estate of William Scott between those heirs, who had not yet received their portions. The court agreed, and in 1827 commissioners divided the estate. Mary E. Scott and her siblings, Jane Margaret Scott and James Ross Scott, received two plantations, "twelve mules and sundry utensils and plantation carriages," and 103 slaves. The Scott children also own two other tracts of land in common with other heirs. Since the partition, Mary has married James Davis and "is desirous that her portion of the property hereinbefore mentioned should be divided off to her." Some of the heirs are minors, however, "and incapable of making a valid partition." The petitioners ask the court to divide the property among the heirs "according to their respective rights."
