Abstract

Benjamin Hunt seeks to revive, "by way of supplement," a bill filed by Charles and Sarah Brown in 1820 against William Stevens Smith and Peter Cuttino, administrators of the estate of George Smith and Savage Smith, along with the widow and heirs of the late Savage Smith. The Browns sought "an account of the joint Estates of George and Savage Smith," stating that the Smiths "carried on business as Merchants and Planters and acquired a very great Estate in lands & negroes" and jointly owned two plantations that included more than 600 acres and between 350 and 400 slaves; they also desired a division and settlement of said estates. In 1825 the court ordered that the estates be divided between the several heirs of Savage Smith and Charles and Sarah Brown, the only heirs of George Smith; in addition, each set of heirs was made responsible for any subsequent claims made against these estates. Hunt states that the Browns "assigned ... all their right, title and Interest in the joint Estates," which included 116 slaves, to him for $120,000 and that he "was substituted completely in the place and stead of the said Complainants in the said Bill." He therefore seeks prays that "the original suit may stand revived" and that the defendants may be compelled "to make a full, fair, and perfect account of all the partnership concerns and joint Interests and Estates of George Smith and Savage Smith" and that Peter Cuttino may be restrained from suing him until said account is made and until he has inspected all records.
