Abstract

John J. Singletary seeks to collect a debt from his brother, Thomas Singletary. John advanced his brother some money in 1827 to enable Thomas to prosecute a suit establishing his right and title to four slaves. John purchased these slaves from Thomas for $1250, and Thomas agreed to give their title to John in exchange for some land and the title to a slave named Patsey, whom John had purchased from Thomas at an earlier time. At Thomas's suggestion, John transferred Patsey and the tract of land to one Ann Rowell, who was cohabiting with Thomas and who has since become his wife. John later learned that Thomas had no title to the four slaves "but only acquired possession in consequence of the mistake of the presiding Judge of the Court of Appeals." Soon after John acquired the slaves, the sheriff seized them. In order to "repair the loss," John was forced to sue his brother in an effort to recover damages for the breach of the warranty of title. He now asks the court to subject the land and slave conveyed to Ann Rowell Singletary to the payment of his judgment and execution.
