Abstract

Elizabeth Poppenheim asks John M. Miller to account for his management of her property. "Blind from her infancy, and ... incapable of managing her own property," Elizabeth lived with her uncle, who acted as her guardian. After his death in 1824, John Miller presented himself as a relative interested in her welfare. Convinced of his honesty, Poppenheim gave him control of her property, including thirteen slaves, and moved to his house in Columbia. Dissatisfied with her treatment, she asked her brother to take her away after only one year, but Miller refused to let her go without payment for his services. Fearing that she was in his power, or that he would detain her slaves, she agreed to pay $631.50 to Miller; he later sued her and won a judgment for $492.37 of the agreed amount. Unable to recover the money by levying on her property, Miller is suing again. Poppenheim asks that Miller account to her "as between Guardian and ward" for his management of her property before she pays anything.
