Abstract

Several children of the late Col. John Taylor join their spouses in seeking the partition of Taylor's estate among his heirs. When Taylor died in 1833, he owned a large, wealthy estate including 16,074 acres in three counties, extensive land in Columbia, at least 240 slaves, 200 shares of bridge stock, 600 bales of cotton, "and so forth, of the total value of about two hundred forty thousand dollars." Taylor's widow Sarah and two of his sons have administered the estate. The other heirs, all over the age of twenty-one, requested the administrators to partition the property, but the administrators claim that they must pay $86,000 worth of debts first and that they cannot pay the debts without the court's permission to sell some or all of the property. Moreover, they cite that legal instruction is required as one of the heirs, Sarah Chesnut Taylor, is only four years old. The petitioners ask that the administrators "may set forth ... the quantity and value of said estate, and the amount of said debts." They also ask that the debts be paid immediately and that the remainder of the property either be divided among the heirs directly or be sold and the proceeds divided.
