Abstract

Six children of James Mitchell, "a free colored Man House carpenter of Charleston deceased," seek a partition of their late father's "considerable estate," which included twelve slaves at the time of his death. The petitioners inform the court that five of the slaves have been sold "for the purpose of paying certain Debts of the estate," while three more have been born. The children are now "desirous that the said estate of their Father may be divided among those who are entitled to the same." They ask that their mother, who is administratrix of the estate, render a "true account" of the estate's assets and that a partition of the remaining property be ordered. In their answer, Mitchell's daughter, Amelia, and her husband, Peter Marchant, assert that three of the slaves, Hannah and her two children, belong to the estate of their late daughter, Ann Eliza Marchant. They contend that James Mitchell gave Hannah to his granddaughter in 1819 when Hannah was a child.
