Abstract

Stephen Tennant, administrator of the estate of Francis Dalcour of Cuba, represents that the late John Stoney, a merchant of Charleston, owed Dalcour for "the produce of the crops of the Estate of the said Francis Dalcour, sold by the said John Stoney." Before he died in 1838, Stoney mortgaged "certain plantations and negroes" to John Magrath and James Hamilton, "as Trustees for certain Creditors, in the sum of Four Hundred Thousand Dollars." Stoney named his wife, Elizabeth, and two of his children, Peter and Christopher, executors of his will. Tennant testifies that said executors have not paid any money on the debt owed Dalcour's estate, which now amounts to $19,467.44, including interest. He further complains that the executors and trustees have disbursed large sums of money "in paying simple contract debts in full, as well as in paying the principal and interest of the debt secured by the Bond and mortgage." He asks the court to order the executors, heirs, and trustees to make an account of the estate and to pay the debt owed Dalcour's estate, by a sale of estate property if necessary. The estate slave property comprised of 422 individuals sold for $129,460 in 1842.
