Abstract

Joshua Moody seeks the restoration of his property. Moody asserts that, at the marriages of his son and two daughters, he gave each of them three slaves and "such other advancements as his circumstances permitted." In 1837, being "in a precarious state of health, and having then recently experienced a severe domestic affliction in the death of his wife, he was in a state of great bodily and mental depression ... and he was altogether incapable of attending to his affairs." While in this state, he spent much of his time living at his children's homes; while among them, "it was suggested by his son and sons in law that it would be better for him to divide the remainder of his estate among them." Moody does not have "but a very indistinct recollection" of the events, "but his impression is that he was induced" by various means to convey his property to his heirs. Moody is now "dissatisfied with the manner of life that had been marked out for him" and he has requested his property back. His children have given him access to three of his slaves, "a man, a woman, and a boy," as well as some other minor property, but he wants the remainder restored to him. He prays that the court declare the deed of conveyance fraudulent and that all his property be restored to him.
