Abstract

Edward Thwing seeks an injunction against the sale of his slave. In 1839, Thwing purchased a slave named Rose from John L. Gilchrist for $125. Thwing remained in "peaceable possession" of Rose until "a few days since," when she was seized by the sheriff, Alexander H. Brown. Brown was acting on a writ of fieri facias issued in favor of the Camden Bank of South Carolina against the firm of Bishop, Bowen, Gilchrist, and Company, of which John L. Gilchrist was a member. Thwing asserts "that it does not appear that the partnership funds have been exhausted, nor does it appear that the said negro woman Rose is a part of the same." In addition, Thwing believes that, whether or not Rose was the property of the partnership, Gilchrist had "clearly good" title to sell her. He prays that the sheriff be enjoined from selling Rose "untill the said Bank of Camden S. C. shall have accounted fully and shewn the amount of money paid to them ... and untill the joint assets are shewn satisfactory to this Court to be exhausted."
