Abstract

Lucretia Burton, along with her son and her grandson, seek a distribution of her late husband's estate. William Burton died in 1828 and by his will he left his land and slaves to his widow, the petitioner, for use during her lifetime; at her death, the property was to be divided among their children and grandchildren. The slaves have increased to sixty-three, as several of the female slaves have recently had children; in addition, the slave named Dan was "bought for the estate" in exchange for Kenley. Also, since the death of William Burton, two of his sons have died. Lucretia is "now advanced in years" and though she wishes to maintain control of fifteen of the slaves and all of her land, "she is desirous" that the remainder of the property "should be sold, and divided among the legatees of said testator and the distributees of her said sons William & James G. Burton deceased." The petitioners therefore pray that the court grant them a writ of partition and that it appoint commissioners to oversee the division and sale of the property.
