Abstract

Alexander Herbemont, administrator of the late Nicholas Herbemont's estate, seeks to be relieved of his duties. The petitioner represents that he sold the perishable personal property and paid the estate debts and minor legacies soon after Nicholas’s death. All that remains to be done is to settle the bequest in favor of the main heir, Paul Bofil, the testator's grandson. The bequest consists of a tract of land called Palmyra, some lots in town, and four slaves. Bofil, who is still a minor, has recently returned to South Carolina after a two-year stay in the North for his education, and he is now married. Alexander Herbemont has put Bofil in the possession of two of the slaves, but he finds that he cannot agree with him and therefore wants to be discharged from further liabilities. He contends that the estate is not sufficient to meet the expenditures required by Bofil and his bride, and he recommends that the least productive part of the estate be sold and the bequest surrendered to Bofil. However, because Bofil is still a minor, he needs authorization of the court to proceed. The commissioners’ report reveals that the value of all four slaves is less than $1,150.
