Abstract

William H. Hampton, a free man of color, represents that his wife, Henrietta Nelson Hampton, also a free person of color, died intestate in 1841 and that he is the administrator of her estate. Hampton claims that Henrietta’s estate includes "twelve shares in the Planter’s & Mechanic’s Bank," but that the "certificate of which stands in the name of Harriet Huger a sister to the said Intestate and wife of Benjamin T. Huger both free people of color." Hampton charges that he has applied to Harriet and her husband and to the President and Directors of the Bank, to transfer the shares to the estate, but they have all refused. He therefore asks the court to cite the Hugers, as well as the Bank’s President and Directors, to appear and answer the premises of his suit. He prays that the shares be decreed the property of his wife’s estate and that the Bank be compelled to transfer them to him. He also prays that the Hugers be directed to account for the dividends that they received during his wife’s lifetime and since her death.
