Abstract

John and Tabitha M. Matthis seek an injunction and request the sale of three slaves. Elizabeth Morgan executed a last will and testament, in which she "disposed of her Estate both real and personal principally to her four daughters." One of said daughters, Nancy Morgan, has died while the other three women, Tabitha, Mary, and Susannah, have all married. The three daughters have "sold and conveyed their real Estate left them by the Will." Only a slave named Jenny and her two children remain undivided. The petitioners report, however, that "Jenny together with her children have been levied upon" by the sheriff. The petitioners ask for an injunction preventing further action against Jenny and her children. The Morgans also pray that Jenny and her children be sold and that the proceeds be divided among the three daughters of Elizabeth Morgan.
