The widow and two of the children of the late William Waits seek an injunction to prohibit Waits's administrator from selling property in the intestate's estate. Mary Waits and her sons, Benjamin and Simpson, represent that William Waits died “seized and possessed” of considerable property that included land, livestock, and twenty-nine slaves. Shortly thereafter, John Paysinger was appointed administrator of the estate, and he is trying to sell the property, even though the intestate left very few debts. The petitioners do not want the property sold; instead, they want it divided in kind among all the heirs, who include themselves and six other sons. They therefore pray that a writ of partition of the property may issue.
