Abstract

Thomas and Lavinia Parker seek an accounting and settlement of the estate of Thomas H. Egan. They attest that Lavinia, "the natural daughter" of Thomas, resided with her father until his marriage to Sarah Colvin. Shortly thereafter, Sarah "secretly, fraudulently and forcibly" removed Lavinia to the Georgia border; Lavinia found a family to live with and remained in Georgia until her marriage to Thomas Parker. The Parkers report that, during this time, the said Egan tried to find his daughter but to no avail and that he died in 1820. Before his death, Egan executed a last will and testament, in which he bequeathed his wife Sarah all his real and personal estate. The document further stipulated that Lavinia was to receive enough funds to ensure her maintenance and to "buy her a little african negro girl." In 1824, Sarah married Isaiah Thompson, who "went into the possession of the said real and personal property," including lands and slaves. The Thompsons purchased more land and five other slaves with funds from the estate. The Parkers assert that such actions have defrauded the "complainants of their rights, interest, & estate under the" will. Therefore, they request that the defendants deliver up all property from the Egan estate and account for their actions. The petitioners further ask that money be directed for Lavinia's maintenance and the purchase of a slave.
