Abstract

Benjamin Lester sues executor William K. Lindsey for possession of Isaac, a slave willed to Lester by his late grandfather, Benjamin Lindsey. Lester explains that his grandfather willed him Isaac and Esther outright and a third slave named Rose after the death of Lindsey's widow. William K. Lindsey, the executor of the estate, refuses to deliver Isaac. Lester states that he agreed to sell Isaac to Lindsey "rather than have to remain in this county and to be compelled to institute Legal proceedings." A third party appraised Isaac, and Lester was willing to accept the price, but Lindsey refused to pay or give him the slave. Lester asks the court to compel Lindsey to surrender Isaac and to account for the slaves' hire since the death of Benjamin Lindsey.
