Abstract

Nathaniel Foster asks that his brother, Pleasant Foster, "be decreed to have no further controll possession or management of the person or Estate of the said Edmund Foster." He informs the court that his father, John Foster, died in 1823 and that his will directed that "my sons Nathaniel and Pleasant shall take care of my son Edmund after the death of their mother." The petitioner reports that his mother died in 1843 and that "the said Edmund Foster is still living;" however, Edmund "is unfortunately an idiot, and, has been so regarded by the testator ... from the time of his birth or infancy." Foster charges that Pleasant "has taken from your orator forceable possession of a portion of the property of the said Edmund Foster ... that he has also the possession of the person of the said Edmund Foster, and continues to keep him in his possession in opposition to the will of your orator." Citing that Pleasant has become "drunken, improvident and lazy," Nathaniel contends that "the said Pleasant Foster is wholly unfit for the trust reposed in him by the will of the testator." He therefore prays that "some other, suitable person may be appointed to take the sole & entire management and controll of the person & Estate of the Said Edmund Foster."
