Abstract

Amelia Moody, one of seven heirs to the late Robert Moody, asks that Barfield Moody, her uncle and guardian, account "to her for his actings and doings as Guardian." She states that, at the time of his death in 1836, her father was possessed "of a large real and personal Estate," which included 21 slaves; that said estate was appraised; and that Barfield Moody returned "a division of the negroes of the said Estate of her said father, but by whom or what Authority Your Oratrix is not advised, by which statement appears" that each heir's "share of negroes" amounted to $1421.44. She submits that her uncle received "letters of Guardianship of her person and Estate" in 1838 and that he "possessed himself of the negroes and monies coming to [him] as aforesaid, and after his return [from Georgia] sold and disposed of the said negroes" for $1700. Moody maintains that her uncle "refuses to come to a fair and just account" and that all of his slaves "are under levy and will be sold" for his debts," rendering "his means ... wholly inadequate to satisfy the demands of your Oratrix." She prays that Moody "may account as aforesaid" and that his security "do pay over to her the sum [that] may be due her upon such account." Moody also requests that both men be restrained "from deporting from the jurisdiction of this Court."
