Abstract

Whitemarsh B. Seabrook, "surviving Trustee" of the late Elizabeth C. Mikell, seeks to sell a slave named Henry. The petitioner represents that James Joseph Murray conveyed certain slaves "in Trust for Elizabeth C Murray (afterwards Elizabeth C Mikell by marriage) and such child or grandchild as she might leave at her decease." Seabrook reports that "one of the negro Slaves conveyed in the aforesaid deed of Trust towit Henry was during the present year 1846 convicted ... of manslaughter on a Slave of Mark Williams and sentenced to receive One Hundred fifty lashes and Six months solitary confinement;" on appeal, the sentence was commuted "to one half the number of lashes & imprisonment with a condition annexed that the said Slave should be banished from the State." Noting that there "being no power in the deed of Trust to sell any portion of the said property," the petitioner prays "this Honourable Court to grant him permission to sell the said Slave Henry."
