Abstract

William Hemphill, the executor of the late William A. Patrick, asks that the proceeds from the sale of a slave named Amos be paid over to him. Hemphill recounts that Patrick was living in Georgia when he died in 1844 but that "a part of the personal property of said William, at his death viz a negroe boy called Amos, was in York District in the State of South Carolina, where he had been hired out by his master." He further states that he was "anxious & desirous to take possession of the said negro boy Amos, in order that he might be carried to the State of Georgia & there disposed of by your orator in a due course of administration." The petitioner reveals, however, that he "was prevented from so doing by one Myles Smith," who "took out letters of administration in South Carolina" on said estate and sold Amos on 31 December 1845. Hemphill asserts that he "exhibited to the said Myles Smith duly certified copies of the said will of William A Patrick ... and demanded of him the proceeds of the sale of Amos but that said Myles contemptuously refused to account to him." The petitioner therefore prays that Smith may "be ordered to account for his administration on the estate of said William A Patrick & he pay over the amount in his hands to your orator."
